Cancellation, Replacement & Termination Policy
Effective Date: January 1, 2026
Sundry Care understands that care needs, schedules, and circumstances can change. This policy explains our general approach to schedule changes, caregiver replacements, cancellations, suspension, and termination of services.
Caregiver Changes and Replacements
Sundry Care carefully considers a client's needs, preferences, personality, schedule, and other relevant factors when assigning caregivers.
Although we work to provide continuity and a strong caregiver match, we cannot guarantee that a particular caregiver will always be available.
Caregiver assignments may change because of illness, time off, emergencies, scheduling conflicts, changes in client needs, employment changes, safety concerns, or other operational circumstances.
When a scheduled caregiver becomes unavailable, Sundry Care will make reasonable efforts to offer an appropriate replacement when one is available.
If a client believes a caregiver is not a good fit, we encourage the client or authorized representative to contact us. We will discuss the concern and, when appropriate and reasonably possible, work to identify another caregiver.
Cancellation of Scheduled Services
Clients may cancel or suspend a scheduled service by providing Sundry Care with at least two (2) days' notice before the scheduled service date.
When less than two days' notice is provided, the client may be charged 50% of the scheduled service hours, subject to the client's Service Agreement and applicable law.
Different cancellation terms may apply when expressly stated in a client's Service Agreement, Statement of Work, membership agreement, or other written service arrangement.
Sundry Cancellations
If Sundry Care must cancel a scheduled service because a caregiver is unavailable and an appropriate replacement cannot reasonably be arranged, the client will not be charged for services that were not provided.
Severe weather, emergencies, unsafe conditions, events beyond our reasonable control, or other circumstances may occasionally require services to be delayed, modified, or cancelled.
Safety
Sundry Care may decline, suspend, modify, or terminate services when we reasonably determine that conditions create an unacceptable risk to the client, caregiver, Sundry personnel, or others.
Examples may include unsafe environmental conditions, violence or threats, harassment, undisclosed hazards, circumstances requiring services beyond our permitted scope, or other significant safety concerns.
Terminating the Service Relationship
Unless another rule applies under the client's agreement or applicable law, either Sundry Care or the client may terminate the service relationship without cause by providing at least seven (7) days' written notice.
Services may be suspended or terminated sooner when permitted by the Service Agreement or applicable law, including circumstances involving material breach, nonpayment, fraud, safety concerns, or other serious circumstances.
Termination does not eliminate amounts already owed for services provided, applicable cancellation charges, reimbursable expenses, or other obligations incurred before termination.
Client Agreements Control
This policy summarizes Sundry Care's general practices. A client's executed Service Agreement, Statement of Work, membership agreement, and applicable state law may provide additional or different rights and obligations.
Where there is a conflict, the applicable agreement and governing law control.
